1. Acceptance of Terms

By utilizing and entering our platform PSTRS, you acknowledge your agreement to abide by the terms and conditions of website access and our privacy policy. Your affirmation includes having read and consenting to our General Terms and Conditions. If you disagree, you are not authorized to use our website or access our services. Please read these terms and conditions carefully before using our services.

2. Description of Service

The Positive School Transition Readiness Survey (PSTRS) provides a platform for schools to assess and track student transition readiness through periodic assessments and reports.

3. User Accounts

Schools and authorized users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You must promptly notify us of any unauthorized use of your account or suspected security breach.

4. User Conduct

You agree not to:

• Use the service for any unlawful or unauthorized purpose
• Impersonate any person or entity
• Upload or transmit viruses, malware, or malicious code
• Interfere with or disrupt the proper functioning of the service
• Attempt to gain unauthorised access to our systems or data
• Misuse, attempt to re-identify, or improperly disclose student data
• Use the service outside its intended purposes

5. Privacy and Data Protection

We take privacy and data protection seriously. Our collection, use, and handling of personal and assessment data are governed by our Privacy Policy, which forms part of these Terms. Schools are responsible for ensuring appropriate permissions are in place for student participation. Student responses are handled confidentially and reported in accordance with the Privacy Policy, including the use of aggregated and de-identified data for school-level reporting.

6. Intellectual Property

All content, features, and functionality of the service, including text, graphics, logos, and software, are owned by DrWellbeing Inc. and protected by copyright, trademark, and other intellectual property laws. The Positive School Transition Readiness Survey (PSTRS), including all assessment questions, scoring algorithms, report formats, and related materials, is the exclusive intellectual property of DrWellbeing Inc. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our service without our prior written consent, except as necessary to use the service for its intended purpose.

All content, materials, and intellectual property provided through the Positive School Transition Readiness Survey on our services are protected by copyright laws. The Positive School Transition Readiness Survey content may not be copied, modified, reproduced, published, or transmitted without prior written consent. Participants may only view or use the Positive School Transition Readiness Survey content under the conditions that: (a) it is not shared with anyone else; (b) it is only used for the purpose for which it was provided to them; and (c) it is used in compliance with the General Terms and Conditions of DrWellbeing Inc. that you can view here.

7. Termination

We reserve the right to suspend or terminate access to the service if we reasonably believe that these Terms have been violated or that use of the service poses a risk to users, the platform, or third parties. Where appropriate, we will provide notice and an opportunity to address the issue prior to termination.

8. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, DrWellbeing Inc. makes no warranties or guarantees of any kind, whether express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or uninterrupted operation. While reasonable efforts are made to ensure the platform functions as intended, we do not guarantee that the service will be error-free, uninterrupted, or free from technical issues, viruses or other harmful components.

To the extent permitted by law, DrWellbeing Inc. disclaims liability for any loss or damage arising directly or indirectly from use of the service, including reliance on platform content, performance, or availability. Users acknowledge and accept the inherent risks associated with the use of online platforms.

9. Limitation of Liability

To the maximum extent permitted by law, DrWellbeing Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising from use of the service. The PSTRS is not intended for diagnosis or clinical decision-making. Schools and users remain responsible for how assessment results are interpreted and applied within their setting.

10. Changes to Terms

We reserve the right to make changes to our web application and services at any time without prior notice. Such changes may include updates, modifications, or discontinuation of certain features or offerings. We shall not be liable to you or any third party for any modifications, suspension, or discontinuation of our services. Your continued use of the service after any changes indicates your acceptance of the modified terms.

Fees and Pricing Changes

Subscription fees for the PSTRS are subject to change at our discretion. If a pricing change applies to an existing subscription, subscribers will be notified in advance of the effective date (typically at least 30 days prior to renewal, unless otherwise required by law). Updated pricing will take effect at the start of the next billing or renewal cycle unless otherwise stated.

Notification of pricing changes may be provided via email to the registered account holder and/or through in-platform notification. Continued use of the service after the effective date of a pricing change constitutes acceptance of the updated fees.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which our company is registered, without regard to its conflict of law provisions.
